Haq-e-Nafqa:

Irshad bari taala hai:
"Khushhal aadmi apni istetaut ke mutabiq aur ghareeb aadmi apni istetaut ke mutabiq maruf tareeqe se nafqah de."
Aurat ko mukhtalif tareeqe se jo kuch maal puhanchta hai is mein milkiyat qabza aur tasaruf ke tamam ikhtiyarat aur haquq ise diye gaye hain jin mein mudakhlat karne ka ikhteyar na is ke baap ko hasil hai na shohar ko aur na hi aur kisi ko mudakhlat karne ka ikhtiyar ho sakta hai. Is ke elawa agar wo kisi tejarat mein apna rupiah laga kar ya khud mahnat kar ke kamaye to is ki malik bhi mukammal tor par wahi hai in sab ke bawajood is ka nafqah har haal mein is ke shohar par wajib hai. Nafqah ke faqhi ahkaam yeh hain keh agar koi mard apni biwi ko nafqah na de to is ki do hi wajahin ho sakti hain aik yeh keh wo istetaut nahi rakhta. Dusri yeh keh istetaut ke bawajood nahi deta.
Istetaut na rakhne ki surat mein mukhtalif faqhi nazaryat hain lekin Imam Maalik ka istadlaal ziadah durust nazar aata hai keh

 “Mahina do mahina ya munasib muddat tak mard ko muhlat di jaye agar is muddat mein bhi wo biwi ke nafqah ka bandobast na kar sake to phir tafreeq (alihdah, talaq) karadi jaye”. 
Istetaut rakhne ke bawajood agar mard biwi ko nafqah na de to yeh zulm hoga aur qaazi ka farz hai keh shohar se zabardasti nafqah haasil kar ke dilwaye phir agar shohar hakim ke hokum ki tameel na karey to aisi surat mein hanafyah kehte hain keh sewaye is ke aur kuch nahi ho sakta keh aurat khud apne nafqah ka intezaam karey. Shohar ke naam par qarz lekar ya mahnat kar ke. Lekin Imaam Malik kehte hain keh aisi surat mein qaazi (judge) ko haq hasil hai keh tallaq waqai kar de. Kiun keh Quran ki ru se nafqah aurat ka haq hai aur jab koi mard istetayat ke bawajood nafqah na karey to aurat ka aise mard se zabar dasti bandhey rahna durust nahi.

Is ke elawa agar wo kisi tejarat mein apna rupiah laga kar ya khud mahnat kar ke kamaye to is ki malik bhi mukammal tor par wahi hai in sab ke bawajood is ka nafqah har haal mein is ke shohar par wajib hai. Nafqah ke faqhi ahkaam yeh hain keh agar koi mard apni biwi ko nafqah na de to is ki do hi wajahin ho sakti hain aik yeh keh wo istetaut nahi rakhta. Dusri yeh keh istetaut ke bawajood nahi deta.

Shohar ke naam par qarz lekar ya mahnat kar ke. Lekin Imaam Malik kehte hain keh aisi surat mein qaazi (judge) ko haq hasil hai keh tallaq waqai kar de. Kiun keh Quran ki ru se nafqah aurat ka haq hai aur jab koi mard istetayat ke bawajood nafqah na karey to aurat ka aise mard se zabar dasti bandhey rahna durust nahi.
