Right to Inheritance

Woman gets her Inheritance from her father, husband, children and other relatives. Allah says that 

For men who share the wealth of parents and relative wide and women to participate in this wealth is stolen by the parents and relative. Although many or too little, and this part is determined by Allah.

Haq Waris:

Aurat ko apne baap, shohar, aulaad aur dusre qareebi rishta darron se warasat milti hai.

Irshad baari taala hai:
“Mardon key liye is maal mein hissah hai jo maan baap aur rishdaron ne chora hai aur auraton key liye bhi is maal mein hissah hai jo maan baap aur rishta daron ne chora ho khwa thora ho ya buhat aur yeh hissah Allah ki taraf se muqarar hai.”
Is ayat mein waza tor par panch qanuni hokum diye gaye hain:
  1. Meras sirf mardon hi ka hissah nahi hai balkeh auratain bhi is ki haq dar hain.
  2. Meras bahar haal taqseem honi chahiye khuwa vo kitni hi kam ho hatta keh agar marne wale ne aik gaz kapra chora hai aur das waris hain to ise bhi das hisson mein taqseem hona chahiye. Yeh aur baat hai keh aik waris dusre warison se in ka hissah khareed le.
  3. Is ayat se yeh baat bhi zahir hoti hai keh waris ka qanun har qisam key amwal aur amlaak par jari hoga khuwa wo manqula ho ya ghair manqula. Zari hon ya sanyati ya kisi aur sanf maal mein shumaar hote hon.
  4. Is se maalum hota hai keh miras ka haq is waqt paida hota hai jab moris koi maal chor mara ho.
  5. Is se yeh qaida bhi nikalta hai keh qareeb tareen rishta dar ki mojudgi mein bayed tar rishta dar miras nahi paye ga.
Aurat ko mukhtalif zaraye se jo maal puhanchta hai is mein milkiyat aur qabza-o-tasruf key tamam ikhteyarat aur haquq ise diye gaye hain jin mein mudakhlat karne ka ikhteyar na is key baap ko hasil hai na shohar ko aur na hi aur kisi ko mudakhlat karne ka ikhteyar ho sakta hai.
Quran ki ru se warasat ka jo qanun banaya gia hai is ka pehla asul yeh hai. Pehli surat yeh hai keh waris mayyat se bila wasta jayaz talluq rakhta ho maslan miyan biwi. Dusri surat yeh hai keh warsa rishta key lehaz se aik darje key hon aur miy-yat key sare maal key bahaisyat asba ( asba in warsa ko kehte hain jo mutayana haquq ki adaigi key baad baqya tamam maal key malik hon) waris hon. Maslan mayyat ki awlaad, bhayi, behan waghairah.
Bazahir in donon suraton mein sanfin key darmian musawat nahi barti gayi aur mard key muqable mein aurat ki maali position kamzor kardi gayi hai lekin agar islam key pure khandani system par ghor kia jaye to haqiqat is key bar aks nazar aye gi islam ne aurat ki maali haisyat ko is ki baaz fitri kamzoryon ki bina par buhat ziada mahfuz aur mazbut kar dia hai jabkeh mard ki iqtesadi halat har aan ghair yaqini aur na mustahkam hai vo agar warasat mein aurat ka adha hissah muqarrar karta hai to do tareeqon se is ski talafi bhi karta hai, aik to yeh keh wo biwi ko shohar se muhar dilwata hai jis ki wo bila shirkat ghire haqdar hoti hai aur dusre yeh keh shadi mein jo maal-o-zewar aur tuhfe-o-tahaif diye jate hain. In ka bhi aurat hi ko malik qarar deta hai.
Yahan aik aur pehlu bhi hai vo yeh keh islam pure khandan ki muashi aur talimi witar biti zummah dari aslant mar par dalta hai bilkhasoos muashi zumma dari. Jis se aurat bilkul mustashna hai. Yahi nahi balkeh wo aurat ka muashi bar bhi shadi se pehle sar parast ko aur shadi ke baad khawand ko uthane par majboor karta hai. Aisi surat mein donon ko waris mein bhi musawi haquq dena kis tarah qaren-e-aqa-o-insaaf ho sakta hai?
In do pehluon se qata nazar jahan islam ne mahaz rishta ka kheyal kia hai wahan aurat aur mard ko musawi darja dia hai. Maslan maiyat ki awlad ki mojoodgi mein waldain ke hisse yaksan hon ge ya bhayi behan (maan jaye bhayi behan) ke darmian bhi islam ne koi farq nahi kia hai.
Doosra asul shariyat ne yeh pesh kia hai. 

“Haquq ko ashab-e-haquq tak punhchao aur jo kuch baqi rahe qaribi rishta dar mard ka hissah hoga.”

Qanon-e-warasat ki yeh dafya is waqt tak samajh mein nahi aasakti jab tak keh islam ke nizam-e- muashrat ke aik dosre ki yeh dafya is waqt tak samjh nahi aasakti jab tak keh islam ke nizam-e-muashrat ke aik doosre asul ko pesh nazar na rakha jaye wo yeh keh islam ne mard par maali baar dalne ke sath rajal khandan ke darmiyan taawun-o-tnasur ke zabte bhi muqarrar kar deye hain. Yeh zabte na sirf ikhlaqi ahmiyat ke hamil hain balkeh inhain qanuni aur dasturi haisyat bhi hasil hai agar aik shakhs aflas ka shikar ho jaye to rajal khandan mein nisbatan jo us se qareeb tar ho ga us par sab se ziadah maali tayawun aur kifalat ki zummah dari hogi.
Qanun-e-warasat mein chunkeh aslan ahmiyat nasab hi ko di gayi hai is liye zabta ke tehat zaruri nahi keh mard ko ziadah hi hissah mile yeh ain mumkin hai keh aik aurat moris se qareebi taalluq rakhti ho aur wo is mard se ziadah hissah paye jo moras ka dur ka rishta dar hai maslan farz kijye aik shaksh apne piche aik biwi, aik larki ya aik behan aur aik chacha chor jata hai to Islami qanun-e-warasat is ke maal-e-matrukah se biwi ko ¼ aur larki ya behan mein se jo ho usey ½ aur chacha ko ¼ dilaye ga.
Warasat ki taqseem ka mukammal Qanun Quran ki mukhtalif aayat mein biyan kar dia gia hai. Irshad bari tala hai:
Tumhari aulad ke bare mein Allah tumhain hidayat karta ahi keh
  • Mardon ka hissah do auraton ke barabar.
  • Agar maiyat ki waris do se ziadah larkian ho to inhain tarkah ka do tehayi dia jaye ga.
  • Agar aik hi lardi waris ho to aadha tarkah is ka hai.
  • Agar maiyat sahib aulad hoto is ke waldain mein se har aik ko takrkeh ka chata hissah milna chahiye.
  • Agar wo sahib-e-awlad na ho aur waldain bhi is ke waris hon to maan ko teesra hissah dia jeye ga.
  • Agar maiyat ke bhayi behan bhi ho to maan chate hissah ki haqdaar hogi.
Yeh sab hisse is waqt nikale jayain ge jab keh wasiyat jo maiyat ne ki puri kardi jaye. Aur jo is par qarz ho ada kar dia jaye.
Miras ke muamle mein yeh awwaleen asuli hidayat hai keh mard ka hissah aurat se do guna hai. Chunkeh shariyat ne khandani zindagi mein mard ziadah muashi zummadaryon ka bojh dala hai aur aurat ko muashi zummah daryon ke bojh se subakdosh rakha hai. Lehaza insaaf ka taqaza yahi tha keh miras mein aurat ka hissah mard ki ba nisbat kam rakha jaye.
